Probate Definitions
Executor
The person nominated by a testator to carry out the directions
and requests in his or her will and to administer and dispose of the property
according to the testamentary provisions. The definition of "executor" for
federal estate tax purposes is discussed elsewhere.
Administrator
An individual appointed by the court, in accordance with the governing statutes, to administer and settle an intestate estate or a testate estate where the named executor is not able to act or is not deemed qualified to act as executor.
Representative
An executor, administrator, administrator to collect, standby guardian, guardian or temporary guardian.
Independent Representative
An executor or administrator appointed and acting pursuant to the statutes governing independent administration.
Interested Person
A person or entity who has or represents a financial interest, property right or fiduciary status which may be affected by the action, power, or proceeding involved in the administration and disposition of the probate estate. This definition also applies to an "interested party," "person or party interested" and "person or party in interest." The most common interested persons are an heir, legatee, creditor, person entitled to a spouse's or child's award, and the representative.
Guardian
(1) A representative of a minor and/or (2) a representative of a person under a legal disability.
